GRL PWR JYM LLC – Member Waiver, Release of Liability, and Membership Agreement

1. Acknowledgment and Assumption of Risk

I understand and acknowledge that participation in physical exercise and use of gym equipment at GRL PWR JYM LLC DBA GRL PWR JYM involves inherent risks, including but not limited to serious injury, illness, or death. I voluntarily choose to participate and assume all such risks.

2. Release of Liability

In consideration for access to the facilities and services of GRL PWR JYM, I hereby release and discharge GRL PWR JYM, its owners, employees, contractors, and agents from any and all claims, demands, actions, or causes of action for personal injury, property damage, or wrongful death that may result from my use of the gym facilities, participation in classes, or use of equipment, whether caused by negligence or otherwise.

3. Use of Equipment and Facility

I agree to use the equipment and facilities properly and follow all posted rules and staff instructions. I am solely responsible for determining whether I am physically fit and able to participate. I understand that misuse of the equipment or failure to follow instructions may result in injury.

4. Annual Membership Commitment and Payment Consent

By selecting the Annual Membership option or Student/Teacher Annual Membership option, I understand and agree that I am committing to a 12-month membership term, and that I am responsible for the full annual payment, either in one lump sum or according to the payment plan selected.

In accordance with Nevada Revised Statutes § 598.948, this contract is binding for one year and may not be canceled or refunded unless:

• The facility ceases operation;
• I become permanently disabled with proof from a licensed physician;
• I move more than 25 miles away from the facility and provide sufficient proof.

5. Right to Refuse Service and ID Verification

GRL PWR JYM reserves the right to refuse service to anyone at its sole discretion. Submission of payment or registration online does not guarantee membership. All memberships are contingent upon presentation of valid identification and the signing of this agreement and any required forms in person on the first day of check-in. Failure to complete these requirements may result in cancellation of access.

6. Non-Payment, Default, and Collections

I understand and agree that failure to make any required payment when due constitutes a default of this agreement. In the event of non-payment, GRL PWR JYM LLC reserves the right to suspend or terminate access to the facility and pursue all lawful remedies to collect the outstanding balance.

If payment is not received after reasonable notice, the unpaid balance may be referred to a third-party collections agency, and I agree to be responsible for any reasonable collection costs, including agency fees, attorney’s fees, and court costs, as permitted by law.

7. Governing Law

This agreement is governed by the laws of the State of Nevada.

By signing below, I confirm that I have read, understood, and agree to this waiver and membership agreement. I acknowledge that I am signing this agreement voluntarily.
